NOTICE OF DEFICIENCY AND ORDER. The Clerk is directed to change the caption to reflect that the Warden of the Eden Detention Center is the only proper respondent. All other named respondents will be terminated from this civil action. The Clerk is directed to change the caption of this case to reflect that the only proper petitioner is Saiz-Garcia, who is proceeding pro se. Almanza will be removed as a party to the case. As a result, if Saiz-Garcia wishes to pursue these habeas claims, he must file an amended petition on the proper form within 30 days. The amended petition must be signed by him or a licensed attorney. The Court cautions Saiz-Garcia that an amended petition will supersede and replace the original petition, so he must include all applicable grounds for relief in the amended petition. If Saiz-Garcia fails to timely file an amended petition, the Court will dismiss this action without prejudice for want of prosecution, without further notice. See Fed. R. Civ. P. 41(b). The pending requests for a temporary restraining order and preliminary injunction, Dkt. Nos. 2, 3, are denied without prejudice to Saiz-Garcia's right to seek similar relief if he desires. The Clerk is directed to mail a copy of this order to Almanza. But she will not receive any further notice of the proceedings here. The Clerk is also directed to mail Saiz-Garcia a copy of the original petition and supporting documents, Dkt. No. 1, the Courts standard instructions to a non-prisoner pro-se party, and a blank Section 2241 form marked "amended" and stamped with this case number.
