Civil Case Terminated. (PW)
Jun 24, 2026
ORDER denying 1 . Petitioner seeks "a bond hearing pursuant to 8 U.S.C. § 1226(a)," but has, since filing this petition, been provided with such a hearing. The immigration court denied bond and the Court lacks jurisdiction to review that decision. See 8 U.S.C. § 1226(e). Petitioner claims that, "without relief from this court, he faces the prospect of months, or even years, in immigration custody," which the Court construes as an argument that the duration of his detention violates due process. That's wrong. Petitioner has been detained for less than two months, and thus the duration of his detention is presumptively reasonable. See Zadvydas v. Davis, 533 U.S. 678, 701 (2001). A "prospect" is not a violation of due process. Ordered by Judge Brian M. Cogan on 6/24/2026. (PW)
