TEXT ORDER- Currently pending before the Court is Petitioner's habeas petition which seeks only "immediate protection from an imminent, unlawful transfer from Delaney Hall." Absent unlawful detention, however, the Attorney General has the authority to determine the appropriate place of detention for immigration detainees. See 8 U.S.C. § 1231(g)(1) (2012) ("The Attorney General shall arrange for appropriate places of detention for aliens detained pending removal or a decision on removal."). Prior to screening the Petition for dismissal under Rule 4, the Court will provide Petitioner's attorney with the opportunity to submit an amended petition or brief clarifying Petitioner's claim(s) for relief.
