PAPERLESS ORDER. THIS MATTER is before the Court following the December 11, 2025 Motion Hearing. (DE 14). For the reasons set forth at the Hearing, it is ORDERED AND ADJUDGED as follows: 1. The November 24, 2025 custody redetermination hearing ("Bond Hearing"), see (DE 11-1; DE 11-2), did not comply with the Court's November 21, 2025 Order (DE 6 ) or due process. Therefore, Petitioner's Motion to Enforce Habeas Order and For Immediate Release (DE 9 ) is GRANTED IN PART. 2. Respondents shall afford Petitioner an individualized bond hearing consistent with 8 U.S.C. § 1226(a), due process, and all law that is applicable at such bond hearings, including that the immigration judge ("IJ") make their determinations based on '"probative and specific' evidence." Matter of R-A-V-P-, 27 I. & N. Dec. 803, 804 (BIA 2020) (quoting In Re Guerra, 24 I. & N. Dec. 37, 41 (BIA 2006) (stating that "[a]ny evidence in the record that is probative and specific can be considered" at a custody determination hearing under § 1226). 3. On or before December 18, 2025, Respondents shall provide Petitioner's counsel with all evidence used to support the allegations and arguments made by the government at the Bond Hearing, including that Petitioner is gang-affiliated, has gang markings, that Petitioner consented to a search of his phone by Homeland Security Investigations ("HSI"), and that child sexual abuse materials were found on Petitioner's phone. Included within this directive are all descriptions and photographs of markings or tattoos on Petitioner that the government believes are gang-affiliated and a copy of the photo found on Petitioner's phone which was referenced at the Bond Hearing and in the EARM report (DE 11-2 at 35). Additionally, Respondents will provide Petitioner's counsel with any documents or consent forms detailing where, when, and under what circumstances Petitioner gave consent for his phone to be searched by HSI agents. Immediately upon compliance with this order, and no later than December 19, 2025 at 5:00 p.m., Respondents shall file a notice of compliance on the docket describing the materials they have provided to Petitioner's counsel. 4. Respondents may request any relief necessary to ensure sensitive information is protected. 5. As soon as practicable, Petitioner shall ascertain what date between December 22, 2025 and December 26, 2025--or the next week--is optimal for the IJ and Petitioner to hold the bond hearing and shall inform the Court of that date via email to chambers. 6.
