FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Sean C. Riordan on 05/31/2026 RECOMMENDING that Petitioner's 1 Petition for Writ of Habeas Corpus be granted with respect to claim one, Respondent's 6 Motion to Dismiss be denied, and that Respondents be ordered to immediately release Petitioner from Respondents' custody and at the time of release, Respondents be required to return all of Petitioner's documents and possessions. It is further RECOMMENDED that Respond ents be enjoined and restrained from re-detaining Petitioner for anypurpose, absent exigent circumstances, without providing Petitioner notice and a pre-detention hearing before an immigration judge pursuant to 8 U.S.C. § 1226(a), the Clerk be d irected to serve the Mesa Verde Detention Center with a copy of any order granting release, that any final order entered in this case not address the circumstances in which Respondents may detain Petitioner in the event Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal, and that the Clerk be directed to enter judgment in favor of Petitioner and to close this case.
