MINUTES for proceedings held before Magistrate Judge Kayla D McClusky: STATUS CONFERENCE held on 3/4/2026. Participating by telephone were: Jesse Paul Levine, David Joseph Rozas on behalf of Petitioner Azmera Kesete, and Shannon Thornhill Smitherman on behalf of Respondents. Ms. Smitherman requested the conference to explain that Respondents believed that they previously fully responded to the Petition at the time they opposed the TRO. However, she further informed the undersigned and opposing counsel that she did have additional factual information she wishes to provide to the Court. Ms. Smitherman will be out of the office after tomorrow until next Thursday, so she requested to either file a supplemental response by tomorrow and then provide the supporting declaration with two weeks of today's date OR to provide the information and supporting declaration with two weeks of today's date. The Court conferred with Petitioner's counsel. Although Mr. Levine raised concerns about the Petitioner's continued detention and the need for the case to be resolved, when pressed, he indicated his preference for the information to be provided tomorrow with a supplemental declaration. Based on that and further discussion, the previously issued Rule to Show Cause [doc. #12] is VACATED. No later than March 5, 2026, Respondents will file a supplement response. No later than March 18, 2026, Respondents will file the supporting declaration for their response. Petitioner shall have seven (7) days to file a supplemental reply if he wishes to do so. However, the Court will check the docket and proceed once that reply is filed, if, as indicated, Petitioner chooses to file more quickly.
