MINUTE ORDER signed by Magistrate Judge Jeremy D. Peterson on 5/22/2026: On 5/7/2026, petitioner filed a petition for writ of habeas corpus, in which he appears to allege that he has previously been paroled by DHS. (See ECF No. 1 18.) Petitioner also alleges that he has a social security card and that he has received employment authorization. (Id. 23.) On 5/21/2026, respondent filed an answer, in which it alleges that petitioner is an applicant for admission within the meaning of 8 U.S.C. § 1225(b)(2). (ECF No. 5 at 1.) Respondent, however, does not discuss petitioner's allegations that he has previously been paroled by DHS and that he has received employment authorization. (See id.) Accordingly, respondent is hereby ordered to file a supplemental answer by 5/28/2026 that addresses whether petitioner has previously been released from DHS custody, and whether petitioner has received employment authorization. Respondent is also ordered to file petitioner's Form I-213 by this deadline. Petitioner still may file a traverse by 5/28/2026. (See ECF No. 4 at 2.) The matter will thereafter be deemed submitted.
