TEXT ORDER This matter comes before the Court upon Petitioner Yerson Andrey Sanchez Carrillo's Petition for Writ of Habeas Corpus under 28 U.S.C. 2241. Dkt. No. 1 ("Petition"). Petitioner is detained in the Pike County Correctional Facility in Pennsylvania and challenges his detention by immigration authorities, who arrested Petitioner in Linden, New Jersey, on April 20, 2026, as unlawful. Petition at 2. A habeas petition under Section 2241 must be filed in the petitioner's district of confinement and name his immediate custodian as the respondent. Rumsfeld v. Padilla, 542 U.S. 426, 435, 443 (2004). The Petition does not comply with this rule, despite Petitioner's knowledge that he was not detained in New Jersey at the time his petition was filed; therefore, the Court lacks jurisdiction. See Khalil v. President, United States, 164 F.4th 259, 268 (3d Cir. 2026) ("jurisdiction lies in only one district: the district of confinement[.]") To cure want of jurisdiction, the Clerk shall transfer the Petition to the United States District Court, Middle District of Pennsylvania, pursuant to 28 U.S.C So Ordered by Chief Judge Renee Marie Bumb on 05/05/2026.
