Drozd on 11/12/2025: Pending the issuance of the court's order resolving the pending 3 motion for temporary restraining order, and unless and until the court orders otherwise, the court ORDERS that defendants shall not take any action to remove plaintiff from the United States or to move plaintiff out of the Eastern District of California. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (acknowledging the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). Given the exigent circumstances present, the court finds that this order is warranted to maintain the status quo pending its forthcoming order resolving petitioner's pending 3 motion for temporary restraining order. Further, no later than today, 11/12/2025, by 5:00 PM, petitioner's counsel is DIRECTED (1) to serve respondents with a copy of the petition, motion for temporary restraining order, and accompanying papers, along with this order, by e-mail to the United States Attorney's Office for the Eastern District of California; and (2) to promptly file proof of such service on the docket. Counsel for respondents shall promptly enter Notices of Appearance. Respondents shall file a written opposition to the pending 3 motion for temporary restraining order by 5:00 PM on Thursday, 11/13/2025. Petitioner, an immigration detainee proceeding through counsel, filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. Petitioner paid the filing fee. Rule 1(b) of the Rules Governing Habeas Corpus Cases Under Section 2254 allows a district court to apply any or all of the rules to other types of habeas corpus petitions including § 2241 petitions.On November 14, 2025, the district court granted petitioner's motion for temporary restraining order and ordered petitioner's immediate release. (ECF No. 12.) On January 8, 2026, respondents confirmed petitioner's release. (ECF No. 17 at 11 n.1.) On February 2, 2026, the district court converted petitioner's motion for temporary restraining order to a motion for preliminary injunction, granted the preliminary injunction, and referred the matter to the undersigned for all further pretrial proceedings. (ECF No. 20.)Accordingly, IT IS HEREBY ORDERED: If additional briefing is needed to decide the petition on the merits, within 30 days of the date of this order, the parties must so inform the Court. If the parties do not inform the Court by this deadline that additional briefing is needed to decide the petition on the merits, the Court will interpret this as confirmation that the petition may be decided on the merits based on the record currently before the court without any additional briefing.
