TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Clemente Claudio Naekat Zabala, a native and citizen of Ecuador currently detained at the Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) According to the Petition, Petitioner entered the United States without inspection in or about June 2023 and was subsequently released on his own recognizance following issuance of a Notice to Appear in immigration proceedings. Petitioner alleges that on April 25, 2026, he was taken into custody by United States Immigration and Customs Enforcement and has since been detained pursuant to 8 U.S.C. § 1225(b) without an individualized bond determination. Petitioner contends that his continued detention violates the Due Process Clause of the Fifth Amendment and is unlawful. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE within seven (7) days of the filing of this Order, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket.
