Judge Brian E. Murphy: ELECTRONIC ORDER entered. Respondents concede that “Petitioner is detained under 8 U.S.C [s.] 1226(a).” Dkt. 7 at 1. However, Respondents failed to, “[a]s part of their response regarding Petitioner’s class membership, whether in the negative or the affirmative,... include, at least, copies of any Notices to Appear, Warrants for Arrest of Alien, or Notices of Custody Determination issued in connection with Petitioner’s current detention,” as directed by this Court. Dkt. 4 at 2. The Court explained that “[i]f Respondents concede that the legal issues presented in Petitioner’s petition are similar to those of cases in which this Court has concluded that 8 U.S.C. § 1226 governed the detention at issue, and a warrant has not been provided, Petitioner will be ordered released.” Id. (emphasis in original). Here, Respondents concede that section 1226 governs Petitioner’s detention, but failed to provide a warrant in support of such detention. Accordingly, the GRANTS this Petition, and ORDERS that Petitioner be released immediately. (MBM) (Entered: 05/13/2026)

Judge Brian E. Murphy: ELECTRONIC ORDER entered GRANTING 10 Respondent's Motion for Reconsideration. The Court notes that Respondent not only failed to include the requisite warrant in the first response, but the response itself missed the Court-ordered deadline by nearly one hour. Dkt. 7 . Respondent has now provided the requisite documents, Dkt. 10 -1, five days after the Court ordered them to be produced, Dkt. 4 .However, the Court is sympathetic to the volume of cases for which Respondent is responsible and recognizes the speed with which Respondent filed the Motion for Reconsideration and supporting documents. Accordingly, the Court GRANTS the Motion for Reconsideration, but notes that such lenience should not expected moving forward, given the nature of the liberty interests at stake. The Court ORDERS that Petitioner receive a bond hearing pursuant to 8 U.S.C. s. 1226(a) on or before May 20, 2026 to consider the merits of his release.
