ORDER by Magistrate Judge Rozella A. Oliver: denying 3 Petitioner's Motion for Temporary Restraining Order. Pursuant to General Order No. 26-05, the Court set an expedited briefing schedule for the petition for writ of habeas corpus in this case. It is not certain that the merits of the TRO motion can be decided before the merits of the habeas petition. Even if there is a delay that results from awarding relief to Petitioner on the merits of the petition, it would be brief. Accordingly, the Court concludes that awarding relief via a TRO is not warranted. See Winter v. Natural Res. Def. Council, Inc., 555 U.S. 7, 22 (2008). For these reasons, the motion is DENIED.
