ORDER TO SHOW CAUSE: 1. Guzman filed the instant petition on May 5, 2026, requesting that Respondent Jessica Sage provide him with an individualized bond hearing. (Doc. 1, at 6). 2. According to Guzman, his detention pursuant to 8 U.S.C. § 1226(c) and the Laken Riley Act has become unconstitutionally prolonged because Respondent has detained him for eight months, without an opportunity to seek release or bond. (Doc. 1, 2-3). 3. In German Santos v. Warden Pike County Correctional Facility, 965 F.3d 203, 211 (3d Cir. 2020), the Third Circuit found that detention under § 1226(c) can grow unreasonable long, in violation of the Due Process Clause of the Fifth Amendment. 4. The Third Circuit further found that to justify continued prolonged detention under § 1226(c), the government must show by clear and convincing evidence, that [the detainee] would likely flee or pose a danger to the community if released. 5. The Clerk of Court shall make immediate and proper service of the petition for writ of habeas corpus (Doc. 1) and this Order on Respondent. 6. Respondent shall not transfer Guzman without further order of the Court. 7. Respondent shall file her response to Guzmans petition on or before WEDNESDAY, MAY 13, 2026. 8.
