MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 5/13/2026. On May 12, 2026, petitioner Jorge Adalberto Rodriguez Lopez filed an emergency motion 7 9 to enforce the court's order 3 prohibiting the federal respondents from transferring Lopez out of this district, with the exception of effectuating his lawful deportation. Lopez's counsel represents that he was moved to Arizona two days after that order was entered, and that the federal respondents informed him that the move was "for removal." Lopez's counsel is concerned that the federal respondents are going to remove Lopez--a Cuban citizen--to Mexico and that removal might be unlawful.IT IS HEREBY ORDERED that the federal respondents must respond to Lopez's motion by 5:00 p.m. on May 15, 2026. The response must address where they intend to remove Lopez and attach all relevant documents related to Lopez's transfer out of the district and his pending removal. If the respondents intend to remove Lopez to Mexico or any country that is not designated in his removal order, the respondents must provide evidence showing if, how, and when Lopez was notified of removal to that country. Lopez must file a reply by 5:00 p.m. on May 18, 2026.Respondents must not remove or further transfer the petitioner until the court has ruled on his motion. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting that the court may use its "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 6/12/2026. Petitioner Jorge Adalberto Rodriquez Lopez, a Cuban national, moves to prevent his removal to Mexico and for his transfer back to this district while his habeas petition is pending. 16 21 The federal respondents previously misrepresented that Lopez was already deported to Mexico, when he was still detained at a staging center in Arizona. 11 And it appears that the federal respondents violated this court's order prohibiting Lopez's transfer out of this district by sending him to the Arizona detention facility in the first place. The record reflects that the federal respondents' attempts to remove Lopez to Mexico may also be an unlawful third-country removal. 21 I find good cause to order Lopez's return to the District of Nevada for the duration of his habeas proceedings. The federal respondents have violated the courts order prohibiting his transfer and have misrepresented key facts about his immigration status. I am also not convinced by the respondents' arguments concerning the legality of Lopez's third-country removal to Mexico. So I GRANT petitioner's motion for reconsideration of my previous order 16 and order the federal respondents to return Lopez to this district within four days of this order.
