Petitioner is subject to 8 U.S.C. § 1226(c) due to his 2004 conviction for making criminal threats. Doc. 9-1 at 13. Petitioner was detained at the border pursuant to § 1226(c) on March 11, 2026, when he returned from traveling abroad. See Docs. 4 at 2. Given that petitioner was detained at the border while re-entering the country, petitioner has not shown that he is likely to succeed on his due process claim. Petitioner's motion did not raise a due process challenge based on the length of his detention, and he is not foreclosed from raising such a challenge if his detention becomes prolonged. This matter is referred to the assigned magistrate judge for further proceedings, including the preparation of findings and recommendations on the 1 petition for writ of habeas corpus.
