It is hereby RECOMMENDED that 15 Amended Petition for Writ of Habeas Corpus be granted in part and denied in part as follows: The petition be granted as to Petitioner's claim that his continued detention violates substantive due process; the petition be denied as to Petitioner's procedur al due process claim seeking a second bond hearing at which the government bears the burden of proof; To the extent the petition seeks relief directed at Petitioner's medical care or the conditions of his confinement other than release, the p etition be denied without prejudice; Respondent be ordered to immediately release Petitioner Alejandro Cardenas Ramirez (A-221-416-312) from custody. At the time of release, Respondent must return all of Petitioner's documents and possessions ; Respondent may re-detain Petitioner if Petitioner violates the conditions of release and Respondent provides Petitioner notice and an opportunity to be heard as to the alleged violation, or Petitioner becomes subject to an executable final orde r of removal and receives notice of that final order of removal; Respondent shall file a notice confirming Petitioner's release within 3 court days after the release; 21 Motion for Expedited Consideration be denied as moot.
