MINUTE ORDER. Presently before the Court is Petitioner's 1 Petition for Writ of Habeas Corpus Under 28 U.S.C. § 2241 as well as Respondents' 6 Return to Petition. Petitioner received a bond hearing and now seeks review of the immigration judge's denial of bond. (See ECF Nos. 1, 6.) Based on the record before the Court, Petitioner has failed to exhaust his administrative remedies by appealing to the Board of Immigration Appeals and has not raised any basis for waiving exhaustion. Accordingly, the Court DENIES WITHOUT PREJUDICE the 1 Petition. See Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011) (remanding with the instruction to dismiss the petition without prejudice because the petitioner had not exhausted his administrative remedies nor demonstrated grounds for excusing exhaustion).
