EO: The court has received and reviewed Petitioner's Petition for Writ of Habeas Corpus, ECF No. 1 and Motion for Temporary Restraining Order, ECF No. 2 . Pending the court's decision on the Petition, and unless and until the court orders otherwise, the court ORDERS that Respondents shall not transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctionsasmay be necessary to protect its own jurisdiction"). Because the motion, ECF No. 2, seeks only an order barring Respondents from transferring Petitioner--which is effectively the same relief provided by this status quo order--the motion is DENIED AS MOOT.The pro se petition--construed liberally to raise an argument that Petitioner is entitled to a bond hearing under Section 1226--appears to present a legal issue addressed by several other district judges, in this court and others. See, e.g., Aguilar Hernandez v. Chestnut, No. 1:26-cv-00709-DJC-AC, 2026 WL 303477 (E.D. Cal. Feb. 4, 2026); Crispin M. C. v. Noem, No. 1:25-cv-01487-KES-HBK (HC), 2026 WL 70553 (E.D. Cal. Jan. 8, 2026). Given the substantial percolation of these issues, the court intends to rule directly on the Petition. See28 U.S.C. §2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require.").On or before May 7, 2026, Respondents are ORDERED TO SHOW CAUSE as to whether there are any factual or legal issues in this case that render it distinguishable from prior orders such as the ones listed above and justify denying the Petition, or indicate this matter is not substantively distinguishable. Petitioner may file a reply on or before May 11, 2026.
