(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner filed an ex parte application for a temporary restraining order (TRO) seeking release. Dkt. No. 2. General Order 26-05 sets an expedited briefing schedule for immigration habeas petitions because of the inherent exigency arising out of detention; a petitioner seeking relief even sooner must therefore show "imminent, irreparable harm that cannot be addressed by the standard scheduling order[.]" Dkt. No. 4 at 5. Petitioner's TRO application, filed after he has already been detained for 14 months, fails to make the required showing. The application focuses on the generalized harm from detention and does not identify with sufficient detail any specific, individualized exigency. To the extent Petitioner is concerned about transfer, the General Order also requires at least two court days' notice prior to removal from this district. Id. at 6. The Court will therefore consider the TRO application after completion of the expedited briefing. The parties shall follow the same briefing schedule for the habeas petition: Respondents shall file a response to the TRO application by May 11, 2026; and Petitioner shall file his reply no later than 14 days after the response is filed.
