DOCKET TEXT ORDER: Petitioner seeks expedited consideration of her motion for a temporary restraining order and habeas petition. The court set deadlines governing the government's response and the petitioner's reply to accommodate petitioner's request. The government met its filing deadline. Petitioner's counsel missed her filing deadline. A day after the deadline had passed, petitioner's counsel filed a motion seeking to file an overlength brief. The motion offered no explanation for why petitioner's counsel had failed to meet the filing deadline or seek an extension of time. Accordingly, the court denied the motion. Petitioner's counsel then filed a stipulated motion to accept a late-filed reply memo. The motion does not explain why a timely, pre-deadline motion for extension was not filed. Furthermore, a stipulation to extend a filing time is ineffective without a court order. Nor does the motion show good cause why the deadline could not have been met. Instead, the motion, like the one before it, emphasizes how important petitioner's counsel believes a new, non-binding, Sixth Circuit decision to be. The advent of a new decision does not, of course, provide good cause for missing a court-imposed deadline. And late filings work against the interests of justice as they can deprive the other side and the court of the necessary time to address the belated filing. Finally, late last night, petitioner's counsel filed, without leave, her late, overlength, reply. Despite the foregoing, the court exercises its discretion to consider the late filing here. The sequence of events suggests petitioner's counsel would benefit from a review of the District of Utah Local Civil Rules, which are located on the court's website. Petitioner's counsel, Ysabel Lonazco, is ordered to review this order and this court's local civil rules in their entirety no later than Wednesday, May 20. Signed by Judge David Barlow on 5/13/26.
