MINUTE ORDER (1) Granting in Part Petition, and (2) Denying as Moot Petitioner's Motions. The Court finds that that unreasonably prolonged detention under 8 U.S.C. § 1226(c) without an individualized bond hearing violates Due Process. Weighing the relevant factors, the Court finds that Petitioner's due process rights have been violated by his prolonged detention of approximately nine months. Accordingly, the Court GRANTS IN PART the 1 Petition and ORDERS Respondents to provide Petitioner with an individualized bond hearing within fourteen (14) days of the date of this Order. To the extent Petitioner seeks immediate release from detention, the Court respectfully DENIES IN PART the Petition. The Court also DENIES AS MOOT Petitioner's 2 Request for Appointment of Counsel and 3 Motion for Temporary Restraining Order.
