MINUTE ORDER. Presently before the Court is Petitioner's 1 Petition for Writ of Habeas Corpus Under 28 U.S.C. § 2241. Petitioner received a bond hearing and now seeks review of the immigration judge's denial of bond. (See ECF No. 1.) Petitioner states he appealed his bond denial to the BIA. (See ECF No. 1-2 at 2.) However, exhaustion of administrative remedies occurs only after the BIA provides a decision on Petitioner's appeal. Because Petitioner has failed to exhaust his administrative remedies at this time and has not raised any basis for waiving exhaustion, the Court DISMISSES the 1 Petition without prejudice. See Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011) (remanding with the instruction to dismiss the petition without prejudice because the petitioner had not exhausted his administrative remedies nor demonstrated grounds for excusing exhaustion). Accordingly, the Court also DENIES AS MOOT Petitioner's 2 Motion to Appoint Counsel. (All non-registered users served via U.S. Mail Service)(no document attached) (mxc) (Entered: 05/07/2026)
