TEXT ORDER: The Court held a remote evidentiary hearing on 2/5/26 to address the Petitioner's motion for medical release. DN 19 . Based on the evidence presented by the Petitioner, his counsel, the facility's nurse, and the medical and family records submitted by the parties, the Court finds that the Christian County Jail (contracted to house federal detainees such as the Petitioner) is providing medical care reasonably addressed to treat the Petitioner's hepatitis B condition. Because the Petitioner doesn't allege or establish deliberate indifference to or lack of attention to his medical needs, but merely the sufficiency and nature of his care, the Court lacks any legal basis to "second guess medical judgments." See, e.g., Westlake v. Lucas, 537 F.2d 857, 860 n.5 (6th Cir. 1976). For the reasons discussed during the hearing, therefore, the Court denies his motion for release (DN 19 ), grants the parties' motions to file supplemental responses (DN 27 & 28 ), and encourages counsel to continue discussing any additional and appropriate ways to improve the Petitioner's health while he remains in confinement. (Court reporter: Becky Boyd) (TIC: 43 min.) This Notice of Electronic Filing is the Official ORDER for this entry. No document is attached. cc: Counsel (HMC) (Entered: 02/06/2026)
