TEXT ORDER The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Roberto Alfredo Palomino Herrera, who is presently detained at Delaney Hall Detention Center in Newark, New Jersey. (ECF No. 1.) According to the Petition, Petitioner is a native and citizen of Ecuador who entered the United States on or about December 2024 and was detained by U.S. Immigration and Customs Enforcement on or about April 15, 2026, during a scheduled check-in. Petitioner further alleges that Respondents have classified his detention as subject to mandatory detention under 8 U.S.C. § 1225(b), thereby denying him access to a bond hearing. Petitioner asserts that his continued detention violates the Immigration and Nationality Act and the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is on this 15th day of May 2026, ORDERED that Respondents shall SHOW CAUSE, on or before May 22, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket.
