District Judge Julia E. Kobick: ELECTRONIC ORDER entered. Petitioner Jose Ismael Garcia Sorto’s petition for a writ of habeas corpus under 28 U.S.C. § 2241, ECF 1, is GRANTED as unopposed. Taken into custody by U.S. Immigration and Customs Enforcement on April 16, 2026, Garcia Sorto filed a habeas petition seeking his release from detention on May 1, 2026. ECF 1, ¶¶ 1-2, 21, & p. 10. That day, this Court notified the respondents of the petition and ordered them to respond to the petition by May 8, 2026. ECF 4 and 5. As of May 11, 2026, the respondents have failed to file a timely opposition or otherwise respond to Garcia Sorto’s petition. As there is no apparent lawful basis for detaining Garcia Sorto, his petition for a writ of habeas corpus is GRANTED and the respondents are ORDERED to immediately release him from custody.
