ORDER DIRECTING RESPONDENT TO FILE STATUS REPORT. This Court granted in part and denied in part the Petitioners petition for habeas corpus on June 18, 2026. [ECF No. 10]. In doing so, the Court ordered the Petitioner to receive an individualized bond hearing in front of an Immigration Judge of the United States within ten (10) days of that Order, or by June 28, 2026. The Court directed the Government to file a Notice of the outcome of that bond hearing within seven days of the bond hearing, or by July 5, 2026. No such notice has been filed to date. As such, the Court directs the Government to file a status report as to the status of the Petitioner and inform the Court whether a bond hearing has yet occurred and if so its outcome, and to do so within 24 hours of the entry of this Order. If in that status report the Government informs the Court that a bond hearing has not occurred, the Court directs the Government to Show Cause in its status report as to why the Courts Order has not been followed. ORDER DENYING MOTION FOR IMMEDIATE RELEASE 13 WITHOUT PREJUDICE AND DIRECTING BOND HEARING TO OCCUR NOT LATER THAN WEDNESDAY, JULY 15, 2026, AND NOTICE TO BE PROVIDED TO THE COURT OF THE RESULTS OF SUCH NOT LATER THAN 48 HOURS AFTER ITS CONCLUSION. The Court has reviewed the Parties' filings at ECF Nos. 12, 13, 15, and 16 . The Court DENIES WITHOUT PREJUDICE the Petitioner's request for immediate release, and ORDERS the relief set out herein. It appears that the Respondents' delay in compliance with this Court's prior Order directing the conduct of a bond hearing before an Immigration Judge 10 was solely the result of one or more errors by Respondents' counsel relative to calendaring/notification to Respondents of such Order at 10, and that there is neither evidence of any form of bad faith in such regards on the part of Respondents or Respondents' counsel, nor of any sort of any sort of "persistent lack of compliance' with the Orders of this Court on the part of Respondents as to this matter, as posited in the Petitioner's Motion at 13 . §ORDER DIRECTING PARTIES TO FILE STATEMENTS OF POSITION AS TO RECORDATION OF BOND HEARINGS. The Court has received a flash drive from the U.S. Attorneys Office containing three audio files, two of which seem to concern the Petitioner, Amadou Yero Diallo. The Court is reviewing these files presently. If the Respondent has not already provided the audio files to the Petitioner and Petitioners counsel, the Court directs the Respondent to do so forthwith. Based on the Courts preliminary review of the audio files, it appears that two bond hearings occurred for the Petitioner one on July 15, 2026, and one on July 16, 2026. The bond hearing for Petitioner that was held on July 15, 2026, in front of Immigration Judge Peter McCary, seems to have been held without a Fulani interpreter. This is the bond hearing that the Court was notified of on July 17, 2026, in ECF No. 18-1. The second audio file seems to contain the audio recording of a bond hearing held for the Petitioner on July 16, 2026, in front of Immigration Judge Cory Combs, which appears to have been a do over with a Fulani interpreter present. These are preliminary observations that the Court has made about the timeline of the hearings, but it invites the parties to weigh in as to whether this is the correct sequence of events, as no accompanying notice or position statement was filed by Respondents to explain what is contained in the audio files. The Court thus directs both parties to file a statement of position as to the matters in the audio files, and any other relevant matters, no later than Tuesday, July 28, 2026, at 5:00 PM EDT.
