MINUTE ORDER (Text Only Entry) issued by Relief Courtroom Deputy for District Judge Dale A. Drozd on 5/1/2026: Pending the issuance of the court's order resolving the pending 4 motion for temporary restraining order, and unless and until the court orders otherwise, the court ORDERS that respondents shall not take any action to remove petitioner from the United States or to move petitioner out of the Eastern District of California. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (acknowledging the court's express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction). Given the exigent circumstances present, the court finds that this order is warranted to maintain the status quo pending its forthcoming order resolving petitioner's pending 4 motion for temporary restraining order. Further, the court has conducted a preliminary review of the pending motion and petition for writ of habeas corpus and observes that this case may involve core issues that the undersigned has previously addressed in this context. Accordingly, the parties are advised that if the court concludes that petitioner is entitled to the relief that is requested in the pending motion, then the court will also rule on the merits of the underlying petition. See Fed. R. Civ. P. 65(a)(2) ("Before or after beginning the hearing on a motion for a preliminary injunction, the court may advance the trial on the merits and consolidate it with the hearing."); Dzhabrailov v. Decker, No. 20-cv-03118-PMH, 2020 WL 2731966 (S.D.N.Y. May 26, 2020) (considering the merits of the habeas petition and motion for preliminary injunction simultaneously). Counsel for respondents shall promptly enter Notices of Appearance. Respondents shall file a written opposition to the pending 4 motion for temporary restraining order by 5:00 PM on Monday, 5/4/2026. In that opposition, respondents shall substantively address whether any provision of law or fact in this case would distinguish it from this court's decisions in Ayala Cajina v. Wofford, No. 1:25-cv-01566-DAD-AC (HC), 2025 WL 3251083 (E.D. Cal. Nov. 21, 2025); Perez v. Albarran, No. 1:25-cv-01540-DAD-CSK (HC), 2025 WL 3187578 (E.D. Cal. Nov. 14, 2025); Chavarria v. Chestnut, No. 1:25-cv-01755-DAD-AC (E.D. Cal. Dec. 9, 2025); Yang v. Warden, California City Correctional Center, et al., No. 2:26-cv-00832-DAD-DMC, 2026 WL 765027 (E.D. Cal. Mar. 18, 2026); Quichimbo-Jimenez v. Warden, California City Correctional Center, 2:26-cv-00739-DAD-EFB (HC), 2026 WL 679378 (E.D. Cal. Mar. 10, 2026); Cardenas v. MINUTE ORDER (Text Only Entry) signed by District Judge Dale A. Drozd on 5/7/2026: On 4/30/2026, petitioner, proceeding pro se, filed a motion for temporary restraining order seeking his immediate release from Immigration and Customs Enforcement ("ICE") custody. (Doc. No. 4 .) On 5/5/2026, respondent filed an opposition offering evidence that petitioner was granted voluntary departure by an immigration judge ("IJ"). (Doc. No. 10-2 at 1-4.) Petitioner is a native and citizen of Honduras who entered the United States on an unknown date without inspection or admission. (Doc. No. [10-1] at 2.) On 3/14/2026, petitioner was arrested and taken into custody by local law enforcement in Irving, Texas for assault causing bodily injury to a family member, a misdemeanor offense. (Id. at 16-17.) On 3/22/2026, petitioner was transferred to ICE custody pursuant to an ICE detainer at which time he was issued a warrant and served with a notice to appear. (Id. at 2, 9, 15.) On 4/20/2026, an IJ granted petitioner pre-conclusion voluntary departure, ordering him to depart from the United States on or before 5/20/2026, and further ordering that he will be subject to a final order of removal pursuant to 8 C.F.R. § 1240.26(d) if he fails to depart by that date. (Doc. No. [10-2] at 1-2.) Petitioner waived his right to appeal the IJ's order. (Id. at 3.) Here, because petitioner was granted voluntary departure by an IJ, petitioner's challenges to his detention have been rendered moot. Bonilla v. Noem, No. 25-cv-62395, 2025 WL 3496193, at *3 (S.D. Fla. Dec. 5, 2025) ("To the extent that Bonilla is challenging his detention, the Court has the authority to consider those claims under its federal habeas jurisdiction. However, while the Court has jurisdiction to review Bonilla's wrongful detention claims, the Court finds that the requested relief is effectively rendered moot as a result of the Voluntary Departure Order.").Accordingly, petitioner's motion for temporary restraining order (Doc. No. 4 ) is DENIED. The petition for writ of habeas corpus (Doc. No. 1 ) is referred to the assigned magistrate judge for further proceedings. (Deputy Clerk PAB) (Entered: 05/07/2026)

MINUTE ORDER issued by Courtroom Deputy for District Judge Dale A. Drozd on 5/22/2026: On 5/1/2026, the court issued an order prohibiting respondents from taking "any action to remove petitioner from the United States or to move petitioner out of the Eastern District of California[]" while an order resolving petitioner's motion for temporary restraining order remained pending. (Doc. No. 6 .) On 5/7/2026, the court denied petitioner's motion as moot because he was granted voluntary departure. (Doc. No. 11 .) On 5/18/2026, respondents filed a motion to dissolve or modify the court's prior order prohibiting respondents from transferring petitioner out of the Eastern District of California or removing him from the United States. (Doc. No. 14 .) In light of the court's order denying petitioner's motion for temporary restraining order (Doc. No. 11 ), the court GRANTS respondent's motion to modify (Doc. No. 14 ) and ORDERS that respondents not transfer petitioner out of the Eastern District of California during the pendency of this habeas petition: (1) absent exigent circumstances; (2) or to lawfully execute petitioner's voluntary departure order; (3) or to lawfully execute petitioner's removal order.
