Upon initial review, it appears this Court has jurisdiction over Petitioner who is detained in this district, which Respondents do not dispute. Respondents ask this Court to dismiss the Petition as duplicative for judicial economy and efficiency, but they provide no insight into the substance or status of the matter filed in the Southern District of California. Therefore, TODAY, Respondents are directed to file a copy of the docket, the habeas petition, any pending dipositive motions, and any court orders from the Southern District of California case. Respondents shall also file a record of Petitioner's custodial history and dates of transfer, since he was last detained by immigration authorities. Until the Court issues a ruling in this matter, Respondents shall not transfer Petitioner out of this District. See F.T.C. v. MINUTE ORDER issued by Relief Courtroom Deputy for Chief District Judge Troy L. Nunley on 05/06/2026: Before the Court is Petitioner's motion for temporary restraining order ("TRO"). (ECF No. 2 .) Respondents opposed the motion. (ECF No. 9 .) Petitioner contends his detention violates the Fifth Amendment. (See, ECF No. 1 .) Respondents counter that Petitioner was initially detained pursuant to a warrant and he was subject to mandatory detention under 8 U.S.C. 1226(c) for a qualifying criminal conviction. (Id. at 2.) Petitioner is now subject to a final order of removal and his continued detention is likely mandatory during the 90-removal period under 8 U.S.C. 1231(a)(2). (Id.) Petitioner was detained about April 9, 2026, thus, he not yet been detained one month and his detention is not unlawfully prolonged. Therefore, Petitioner has not carried his burden of a likelihood of success on his claims. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (standard for TRO). Accordingly, Petitioner's request for immediate relief (ECF No. 2 ) is DENIED. However, Respondents may not transfer Petitioner out of this District until the Court rules on his habeas petition. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction.").
