SERVICE ORDER. MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 5/8/2026. Before the Court is the 7 Notice of Petitioner's Legal Transfer filed by Federal Respondents. The Notice states that Prior to the issuance of this Courts order preventing transfer on May 1, 2026, Petitioner was transferred to Arizona on April 28 for the purposes of effectuating his removal order. Federal Respondents attach Petitioner's removal order. They further explain that Petitioner was scheduled for removal on May 5 but due to an unanticipated flight cancellation, his deportation has been rescheduled for May 12.As an initial matter, the Court reminds Federal Respondents that its order preventing any transfer, including deportation, remains in full force and effect at this time. Absent a Court order permitting his removal, Federal Respondents are currently enjoined from deporting Petitioner per this Court's 3 Order. Any deportation prior to a Court order or dismissal of this case would be a violation of this Court's Order.Further, IT IS HEREBY ORDERED that Federal Respondents must file documentary evidence substantiating their claim that Petitioner was transferred out of the district before the Court's 3 Order was entered. Moreover, a check of the EOIR Automated Case Information System indicates that an appeal is pending in Petitioner's removal case. Accordingly, IT IS FURTHER ORDERED that Federal Respondents must file documents evidencing that Petitioner's order of removal is final and no appeal has been filed with the BIA. MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 5/11/2026. On May 8, 2026, the Court entered the 8 Minute Order requiring Federal Respondents to file evidence substantiating their claims in the 7 Notice no later than May 11 at 12:00 P.M. Federal Respondents filed a response to the Court's 8 Order at 1:30 PM, explaining that they "made concerted efforts to obtain this information prior to the deadline established by this Court, but was [sic] unable to obtain them." They further indicate that they "will submit those when procured." Federal Respondents provide no further explanation of their efforts to obtain the documentation, why they have been unable to obtain them, or when they might be able to do so. In its 8 Order, the Court also reiterated that Petitioner is not to be further transferred, including for removal purposes, pending further order of this Court. Federal Respondents did not indicate that Petitioner's May 12 removal has been stayed for the resolution of the Petition filed in this case. Accordingly, IT IS HEREBY ORDERED that the parties shall appear before the Court on May 15, 2025, at 9:00 A.M. in LV Courtroom 7D before Judge Gloria M. Navarro. Petitioner must be present at this hearing. If the parties file a joint status report certifying that Petitioner has been transferred back to this district by May 14, 2026, at 12:00 P.M., the hearing will be automatically vacated, and the Court will set a new deadline for the filing of the documentation described in the 8 Minute Order.
