TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Heinert Luciano Intriago Alvarado. (ECF No. 1.) The Petition was received without the filing fee or a complete application to proceed in forma pauperis as required by 28 U.S.C. § 1915(a). Accordingly, within thirty (30) days of the date of this Order, Petitioner shall either: (1) submit a properly completed in forma pauperis application; or (2) pay the $5.00 filing fee. TEXT ORDER The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Heinert Luciano Intriago Alvarado, who is presently detained at Delaney Hall Detention Center in Newark, New Jersey. (ECF No. 1.) According to the Petition, Petitioner entered the United States on or about November 8, 2023 and has resided here since. Petitioner alleges that he filed a Form I-589, Application for Asylum and Withholding of Removal, which remains pending. Petitioner was detained by ICE on April 16, 2026, while traveling to work and has remained in custody since that time. Petitioner challenges his continued detention as unlawful, unjustified, and in violation of his constitutional rights, and seeks release or an appropriate custody redetermination. (Id.) Accordingly, it is on this 6th day of May 2026, ORDERED that Respondents shall SHOW CAUSE, on or before May 13, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket.
