District Judge Angel Kelley: ELECTRONIC ORDER entered. In his First Amended Petition for a Writ of Habeas Corpus [Dkt. 12], Petitioner alleges that his detention in April 2026 and his bond hearing on May 18, 2026 violated the Due Process Clause. In response, Respondents argue that Petitioner's detention was lawful but do not contest the legality of Petitioner's bond hearing. Respondents, further, "do not object to this Court ordering Petitioner receive a bond hearing in Immigration Court with instructions for the IJ to consider alternatives to detention at such hearing." [Dkt. 14 at 5].Having considered the record before the Court, Petitioner's First Amended Petition for a Writ of Habeas Corpus [Dkt. 12] is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing within 10 calendar days of this Order. At the bond hearing, the Immigration Judge shall consider alternatives to detention.
