ORDER granting Petitioners' 3 Motion for Temporary Restraining Order. Respondents, including their officers, agents, servants, employees, attorneys, or others acting on their behalf, are PROHIBITED from transferring Petitioners from the North west Immigration and Customs Enforcement Processing Center to any other facility during the pendency of these proceedings unless they seek modification of this Order or they obtain a final, executable order of removal. This Order expires November 27, 2025, unless extended by this Court. The Court anticipates that it can rule on the underlying habeas petition within that time. Should an extension be necessary, the Court will set a hearing and briefing schedule for whether to convert the TRO into a preliminary injunction. ORDER. The petition for writ of habeas corpus (Dkt. 1 ) is GRANTED. Within ONE day of this Order, Respondents must do the following: Either release Petitioner Juan Leon Figueroa or allow his release upon payment of the alternative bond amount of $8,000 and any conditions set by Immigration and Customs Enforcement/the Department of Homeland Security. Either release Petitioner Salvador Gudio Herrera or allow his release upon payment of the alternative bond amount of $10,000 an d any conditions set by Immigration and Customs Enforcement/the Department of Homeland Security.Within fourteen days of receiving Petitioner Adolfo Carrillo Ahilon's request for a bond hearing, Respondents must either release him or provide him a bond hearing under 8 U.S.C. §1226(a).Within fourteen days of receiving Petitioner Baltazar Lopez Mendez's request for a bond hearing, Respondents must either release him or provide him a bond hearing under 8 U.S.C. §1226(a).
