MEMORANDUM ORDER (Serving 28 U.S.C. § 2241 Petition) - Upon consideration of Petitioner's payment of the filing fee and the petition annexed, it is ORDERED that: The petition shall be FILED; It appearing to this Court that the factual circumstances and legal issues presented in the § 2241 Petition are materially identical to those presented in other recently filed and adjudicated habeas petitions addressing the propriety of mandatory detention pursuant to 8 U.S.C. § 1225(b)(2), it is ORDERED Respondents SHALL file, within seven (7) days either a Notice indicating that the factual and legal issues presented in the petition do not differ in any material fashion from those presented in Duarte Escobar v. Noem, et al, 3:25-cv-758 (E.D. Va.), or an Opposition to the § 2241 Petition discussing the material differences between Duarte Escobar and the petition. Service shall be made upon Respondents by electronically transmitting a copy of this Memorandum Order and the petition to the United States Attorney for this District. ORDER that the Court GRANTS the Petition. (ECF No. 1 .) Respondents are DIRECTED to provide Petitioner with a copy of this Memorandum Opinion and Order. The Court ORDERS that the Immigration Court provide Petitioner with a bond hearing prior to any hearing on the merits of his removal, and no later than twenty-four (24) hours from the date of entry of this Order, or if that period falls on a weekend, on the next business day. Respondents are ORDERED to file a status report with this Court within three (3) days after Petitioner's bond hearing, stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reason for that denial. In the event that Petitioner is released on bond. Respondents are ENJOINED from rearresting Petitioner, unless he has committed a new violation of any federal, state, or local law, or has failed to attend any properly noticed immigration or court hearing or is subject to detention pursuant to a final order of removal. Should Petitioner be released on bond, Respondents are FURTHER ENJOINED from invoking the automatic slay provision at 8 C.F.R. § 1003.19(i)(2). It is SO ORDERED. SEE ORDER FOR FURTHER DETAILS. (ECF Nos. 6, 7 .) Since that date, Petitioner has not filed anything further or otherwise contacted the Court. Accordingly, the Clerk is DIRECTED to close this matter. The Clerk is DIRECTED to enter a final appealable Judgment in a Civil Case in favor of Petitioner as a separate entry on the docket. Should Petitioner desire to appeal, a written notice of appeal must be filed with the Clerk of the Court within sixty (60) days of the date of entry hereof.
