MEMORANDUM ORDER (Conditionally Filing 28 U.S.C. § 2241 Petition and Requiring Petitioner to Complete the Standardized Forms) - Petitioner, a federal detainee proceeding pro se, submitted a 28 U.S.C. § 2241 petition. He also seeks leave to proceed without payment of the statutory filing fee. It is ORDERED that: The petition is CONDITIONALLY FILED pending payment of any assessed filing fee. The Clerk is DIRECTED to mail Petitioner the standardized form for filing a § 2241 petition. The Clerk shall WRITE the civil action number for the present action on the form. Petitioner is DIRECTED to complete and return the form to the Court within thirty (30) days of the date of entry hereof. Petitioner must state the facts that make his detention unlawful. The Clerk of the Court is DIRECTED to process Petitioner's request to proceed in forma pauperis,. If an appropriate affidavit for proceeding in forma pauperis has not been submitted, the Clerk shall mail an appropriate in forma pauperis affidavit to Petitioner. Failure of Petitioner to complete and return the in forma pauperis affidavit or pay the $5.00 filing fee within fifteen (15) days of the date of entry hereof will result in dismissal of the action. The Clerk shall obtain a certified copy of Petitioner's trust fund account for the six (6) month period immediately preceding the initiation of this action. The Clerk is DIRECTED to send Petitioner a Notice & Consent to Proceed Before a United States Magistrate form. Petitioner should only return this form if Petitioner consents to the jurisdiction of the United States Magistrate Judge. If Petitioner consents to the jurisdiction of the Magistrate Judge, Petitioner should return this form within fifteen (15) days of the date of entry hereof. It is so ORDERED.
