District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The Court has reviewed the government’s response. Doc. No. 16. No later than 2 PM on Friday, May 30, 2025, the government shall supplement its response by producing to the Court and to the petitioner’s counsel copies of the following documents:(1) all documents referenced in the May 23 submission, including: a) a printout of all records regarding the petitioner contained in the EARM database, as referenced in paragraph 3 of Doc. No. 16-1; b) all official records reviewed by Assistant Field Office Director Keith Chan in connection with this action, as referenced in paragraph 4 of Doc. No. 16-1; and c) copies of the I-200 warrant and I-286 notice served on the petitioner on March 5, 2025, as referenced in paragraph 10 of Doc. No. 16-1;(2) any other documents relied upon in the course of preparing either declaration accompanying the government’s response (Doc. Nos. 16-1, 16-2); and (3) to the extent not within the scope of (1) or (2) above: a) any reports created regarding the interaction with and arrest of the petitioner by USBP on March 5, 2025; b) any reports or decisions memorializing the initial determination to detain the petitioner, and the custody “redetermination” referenced in paragraph 9 of Doc. No. 16-2; and c) a copy of any document(s) provided to the petitioner establishing his parole into the United States on July 18, 2024.The Court will hold an in-person hearing on the Motion to Dismiss and the respondents’ May 23 submission. The government shall arrange for Assistant Field Office Director Chan and Patrol Agent in Charge James Trainor to be present to answer questions regarding their affidavits and the following statements in the May 23 submission: a) that the petitioner’s “parole status” was “confirmed” in some way on May 10, 2025, per paragraph 16 of Doc. No. 16-1; b) that “human error” caused the “acceptance” of the petitioner “for detention,” per paragraph 17 of Doc. No. 16-1; and c) that “an administrative oversight” caused USBP to be “unaware” of the petitioner’s parole status, per paragraph 8 of Doc. No. 16-2. If Chan and/or Trainor lack the knowledge required to answer such questions, then the government shall also arrange for additional witnesses with the necessary knowledge to appear. All witnesses must appear in person. The hearing will occur on Monday, June 9, 2025, at 10:30 a.m. in Courtroom 13.
