TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Qin Song Lin, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) According to the Petition, Petitioner is a native of China who entered the United States on or about September 21, 2022, without admission or parole and was thereafter released on his own recognizance by the Department of Homeland Security. Petitioner alleges that on April 28, 2026, he was re-detained by U.S. Immigration and Customs Enforcement and has remained in custody since that time. Petitioner further alleges that Respondents have improperly classified his detention under 8 U.S.C. § 1225(b)(2), subjecting him to mandatory detention. Petitioner asserts that his re-detention violates the Immigration and Nationality Act and the Due Process Clause of the Fifth Amendment, and he seeks immediate release from custody. (Id.) Accordingly, it is on this 4th day of May 2026, ORDERED that Respondents shall SHOW CAUSE, on or before May 11, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings and shall not be transferred outside of this District absent prior leave of Court.
