EO: The court has received and reviewed Petitioner's Petition for Writ of Habeas Corpus, Dkt. No. 1, Emergency Motion to Expedite and for Appointment of Counsel, Dkt. No. 2, and Emergency Motion for Protection from Transfer and Removal, Dkt. No. 3 . Pending the court's decision, and unless and until the court orders otherwise, the court ORDERS that Respondents shall not transfer or otherwise take petitioner out of the Eastern District of California. See California Energy Comm'n v. Johnson, 767 F.2d 631, 634 (9th Cir. 1985) ("The All Writs Act, 28 U.S.C. § 1651(a), empowers the federal courts to issue writs of mandamus necessary to protect their prospective jurisdiction."). Because the Emergency Motion, Dkt. No. 3, seeks an order barring Respondents from transferring, removing, or deporting Petitioner--which is effectively the same relief provided by this status quo order--that motion is DENIED AS MOOT.The court believes this case would benefit from the appointment of counsel. To the extent Petitioner requests appointed counsel, seeDkt. No. 2, that request is GRANTED. Within seven (7) days from the date of this order, the appointing authority for the Eastern District of California shall identify counsel and send counsel's contact information to Smith_Orders@hid.uscourts.gov, and the Clerk's Office shall update the docket to reflect counsel's appointment. If counsel is not a member of the Eastern District of California Criminal Justice Act Panel, within seven (7) days of this Order the Federal Defender shall file a motion to appoint counsel as CJA counsel pro hac vice. Within fourteen (14) days of appointment of counsel, Petitioner may supplement the Petition, Dkt. No. 1 . The Clerk's Office is directed to serve a copy of the Petition on the Federal Defender. After counsel is appointed, the court may set a schedule for briefing on the Petition. Because the court will resolve this matter as expeditiously as possible, to the extent Petitioner also moves to expedite, that request is DENIED AS MOOT.IT IS SO ORDERED. (JUDGE MICAH W. J. EO: The court has reviewed Petitioner's first amended petition for writ of habeas corpus pursuant 28 U.S.C. § 2241. Dkt. No. 8 . The first amended petition appears to raise legal issues addressed in this court and others, including whether Petitioner is entitled to a bond hearing under 8 U.S.C. § 1226(a). See, e.g., Jose C.L.L. v. Chestnut, No. 1:26-cv-03453-MWJS, 2026 WL 1275305 (E.D. Cal. May 7, 2026); Francisco C.T. v. Warden, Cal. City Corr. Ctr., No. 1:26-cv-03308-MWJS, 2026 WL 1234218 (E.D. Cal. May 4, 2026); Ixcox Chum v. Lyons, No. 1:26-cv-02491-KES-EPG (HC), 2026 WL 950765 (E.D. Cal. Apr. 8, 2026). Given the substantial percolation of these issues, the court intends to rule directly on the first amended petition. See 28 U.S.C. §2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require.").On or before May 13, 2026, Respondents are ORDERED TO SHOW CAUSE as to whether there are any factual or legal issues in this case that render it distinguishable from prior orders such as the ones listed above and justify denying the first amended petition, or indicate this matter is not substantively distinguishable. EO: Before the court is Petitioner's response to Respondents' status report and motion to alter or amend judgment, reopen for limited proceedings, and grant further habeas relief. Dkt. No. 16 . On May 12, 2026, the court issued an order that enjoined and restrained Respondents from continuing to detain Petitioner unless they demonstrated by May 19, 2026, that Petitioner had received a bond hearing in accordance with 8 U.S.C. § 1226(a) and its implementing regulations. Dkt. No. 12 . On May 20, 2026, Respondents filed a timely status report confirming that a bond hearing before an immigration judge was held on May 18, 2026. Dkt. No. 15. Petitioner has not shown that the extraordinary remedy of relief under Rule 59(e) of the Federal Rules of Civil Procedure is warranted here. See Kaufmann v. Kijakazi, 32 F.4th 843, 850 (9th Cir. 2022) (stating that a district court may grant a Rule 59(e) motion if it is presented with newly discovered evidence, committed clear error, or if there is an intervening change in the controlling law). Nor, at this point, has Petitioner demonstrated that the court's intervention is needed to enforce its earlier order. See Maksim v. Warden, Golden State Annex, No. 1:25-cv-00955-SKO (HC), 2026 WL 82339 (E.D. Cal. Jan. 12, 2026) (denying motion to enforce judgment where petitioner argued, among other things, that bond hearing did not comply with court order). Petitioner's motion, Dkt.
