TEXT ORDER. Petitioner seeks, among other things, a writ of habeas corpus requiring that Respondents release Petitioner immediately and not re-detain him without a pre-deprivation hearing at which the government bears the burden to demonstrate, by clear and convincing evidence, that the Petitioner is a danger to the community or a flight risk. Dkt. 1. Petitioner's detention has not become "prolonged" under Velasco Lopez v. Decker, 978 F.3d 842 (2d Cir. 2020), such that his case requires burden-shifting at any bond hearing. See Dkt. 1 at 3 (indicating that Petitioner has been detained since April 2026). And on June 9, 2026, Respondents indicated that Petitioner was anticipated to receive a bond hearing on June 10, 2026, under the relevant rules and regulations. Dkt. 4. Accordingly, the parties shall file status reports with the Court by June 29, 2026, explaining whether the June 10, 2026 bond hearing took place, and if it did, why this case should not be dismissed as moot.
