TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Khasan Rasimov, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner, a native of Uzbekistan who entered the United States on or about September 2, 2023, alleges that he was previously released on parole and remained in full compliance with its terms, but was re-detained by Immigration and Customs Enforcement on April 7, 2026, without notice of parole revocation and under an assertedly erroneous application of mandatory detention authority. (Id.) Petitioner further contends that an Immigration Judge vacated a prior negative custody determination on April 20, 2026, and that his continued detention without adequate procedural safeguards violates the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, on or before May 6, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
