Minute Order by Judge Jinsook Ohta: On November 7, 2025, Petitioner filed a petition for writ of habeas corpus requesting injunctive relief. Dkt. 1. Respondents shall answer or otherwise respond to the petition no later than 12 p.m. on November 12, 2025. The Court schedules oral argument on the habeas petition for November 14, 2025 at 9:15 a.m. in Courtroom 4C before Judge Jinsook Ohta.The Court ORDERS Petitioner to serve Respondents with the habeas petition by 5 p.m. on November 10, 2025, and file proofs of service. Petitioner must also serve the U.S. Attorney's Office for the Southern District of California by a method prescribed in Federal Rule of Civil Procedure 4(i) by that same date.Petitioner shall not be transferred to another district unless the government provides advance written notice of the intended transfer. Such notice shall be filed on the docket and shall state the reason for the proposed movement and why it should not be stayed pending further court proceedings. Minute Order by Judge Jinsook Ohta: Petitioner filed a motion to proceed under a pseudonym, specifically with the initials "Y.E.B." instead of his full name, citing safety concerns and fear of retaliation due to his religion and political opinion. Dkt. 3-1 at 2. Proceeding under a pseudonym is appropriate in "unusual case[s]" where nondisclosure of a party's identity "is necessary... to protect a person from harassment, injury, ridicule or personal embarrassment." Does I thru XXIII v. Advanced Textile Corp., 214 F.3d 1058, 1067-68 (9th Cir. 2000) (alteration in original) (quoting United States v. Doe, 655 F.2d 920, 922 n.1 (9th Cir. 1981)). When a party seeks to proceed pseudonymously based on potential retaliatory harm, a district court must balance five factors: "(1) the severity of the threatened harm, (2) the reasonableness of the anonymous party's fears, (3) the anonymous party's vulnerability to such retaliation, (4) the prejudice to the opposing party, and (5) the public interest." Doe v. Kamehameha Sch./Bernice Pauahi Bishop Est., 596 F.3d 1036, 1042 (9th Cir. 2010) (cleaned up) (citing Advanced Textile, 214 F.3d at 1068).Here, Petitioner has demonstrated reasonable grounds to fear retaliatory harm. He states that he is an asylum seeker who faces significant physical threat due to past persecution and fears future persecution in Turkey. Dkt. 3-1 at 4. His concern for safety would be heightened if his identity were disclosed publicly and known to authorities in his home country. See Kamehameha Sch., 596 F.3d at 1043 (noting that threats of physical harm "present[] the paradigmatic case for allowing anonymity"). The Ninth Circuit and district courts have recognized retaliation by foreign governments as a sufficient basis to proceed anonymously. See Advanced Textile, 214 F.3d at 1063; Al Otro Lado, Inc. v. Nielsen, No. 17-CV-02366-BAS-KSC, 2017 WL 6541446, at *8 (S.D. Cal. Dec. 20, 2017). Petitioner also represents that he will disclose his identity to Respondents, thereby minimizing any prejudice from using a pseudonym. Dkt. 3-1 at 6.Based on the Court's review of the severity of the threatened harm, the reasonableness of Petitioner's fears, and his vulnerability to retaliation, the Court finds that the need for anonymity in this case outweighs any potential prejudice to Respondents. See Kamehameha Sch., 596 F.3d at 1042. The Court further finds that revealing Petitioner's identity would not enhance the public's understanding of these proceedings. For these reasons, the Court GRANTS Petitioner's motion to proceed pseudonymously [Dkt. 3]. Petitioner is ordered to provide Respondents with his Alien Registration Number, and/or any other relevant identifying information necessary for Respondents to prepare their response, by 5 p.m. on November 10, 2025.
