ORDER: The Clerk of the Court must serve a copy of this Petition upon Respondents and the Interim United States Attorney for the District of Oregon, Scott Bradford (scott.bradford@usdoj.gov). Respondents shall, within twenty-four hours of being served with this Order, answer or respond to the Petition and Motion for Temporary Restraining Order. Unless otherwise ordered by this Court, Petitioner shall not be moved outside of the District of Oregon without first providing advance notice of the intended move. Such notice must be filed in writing and on the docket in this proceeding and must state the reason that the Respondents believe that such a move is necessary and should not be stayed pending further court proceedings. Once that notice has been filed on the docket, the Petitioner shall not be moved out of the District for a period of at least 48 hours from the time of the docketing. If the 48-hour period would end on a weekend or legal holiday, the period continues to run until the same time on the next day that is not a weekend or legal holiday. Fed. R. Civ. P. 6(a)(2)(C). This period may be shortened or extended as appropriate by further Court order. If Respondents have already moved Petitioner outside of this District, Respondents are ordered to notify the Court within two hours of being served with this Order. Respondents are further ordered to state the exact date and time that Petitioner left the District of Oregon and the reason why Respondents believed that such a move was immediately necessary. The Court reiterates that Respondents must file a Response to the Petition for Writ of Habeas Corpus [ECF 1] and Motion for Temporary Restraining Order [ECF 2] as ordered [ECF 7], which means Respondents Response is due today, November 9, 2025, on or before 6:46 PM (which is 24-hours after Counsel for Respondents acknowledged the emailed service notice [ECF 8]). OPINION & ORDER:The Court concludes that the Respondents may not rely on 8 U.S.C. § 1225(b)(2) to arrest and/or detain Petitioner. As for the alternative basis for arrest and detention, 8 U.S.C. § 1226(a), the Court concludes that wh ile Respondents may revoke conditional release pursuant to 8 U.S.C. § 1226(a), Petitioner is entitled to a prompt bond hearing. Therefore, Petitioner is to be given a bond hearing before an immigration judge within two business days of this Orde r. If no such bond hearing is conducted within the timeframe set forth by this Order, the Court directs Respondents to release Petitioner on conditions previously imposed by the immigration court pending further proceedings, including an out-of-custo dy review of conditional bond before the immigration court.Accordingly, Petitioner's Petition for Writ of Habeas Corpus 1 is GRANTED IN PART and the Court finds as follows:Petitioner is to be given a bond hearing before an immigration ju dge within two business days and if such bond hearing does not take place, Petitioner is to be released immediately for appearance at a bond hearing out of custody; andRespondents are further ENJOINED from pursuing detention of Petitioner on the basis of 8 U.S.C. § 1225(b)(2) because that statute does not apply to Petitioner.Any pending motions, including the Motion for Temporary Restraining Order 2 , are denied as moot.
