ORDER - Petitioner's Motion to Expedite (Doc. 2 ) is denied. Within 30 days of the filing date of this Order, Petitioner must pay the $5.00 filing fee or file an Application to Proceed In Forma Pauperis. The Clerk shall enter judgment of dismissal without prejudice and deny any pending unrelated motions as moot if Petitioner fails to comply. Respondent Unknown Phoenix ICE Field Office Director is dismissed. The Clerk must substitute Luis Rosa, Jr. for Respondent Unknown Warden of the Florence Processing Center. The Clerk must serve a copy of the Summons, the Petition (Doc. 1 ) and this Order upon the United States Attorney for the District of Arizona, United States Attorney General, and to Respondent by certified mail. The Clerk must immediately transmit by email a copy of this Order and the Petition to AUSA Melissa Kroeger, Lon Leavitt, Theo Nickerson, Dina Anagnopoulos, and Mary Finlon. Respondent must answer the Petition within 20 days of the date of service. Petitioner may file a reply within 10 days from the date of service of the answer. This matter is referred to Magistrate Judge Camille D. Bibles pursuant to Rules 72.1 and 72.2 of the Local Rules of Civil Procedure for further proceedings and a report and recommendation.
