TEXT ORDER The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1) filed by Petitioner, Jefferson Daniel Romero Guaman, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. Petitioner alleges that he is a citizen of Ecuador who initially entered the United States without inspection approximately two years ago. Petitioner represents that he timely filed an application for Asylum and Withholding of Removal under the Convention Against Torture, and awaits a hearing scheduled on September 20, 2026. Petitioner contends that he was detained by ICE on April 26, 2026, pursuant to 8 U.S.C. § 1225(b), and that his continued detention violates the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, on or before May 5, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of this Order and the Petition upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket.
