ENDORSED ORDER. Text of Order: The government states that the petitioner is entitled to a bond hearing if the court applies the reasoning in Velasco-Luis v. Hyde, No. 25-cv-12747 (D. Mass. Oct. 6, 2025) and Cardoso Dos Santos v. Hyde, No. 25-cv-12787 (D. Mass. Oct. 7, 2025)), which themselves relied on Judge Saris's order in Guerrero Orellana v. Moniz, --- F. Supp. 3d ----, 2025 WL 2809996 (D. Mass. Oct. 3, 2025). See doc. no. 7 at 10. Guerrero Orellana's reasoning aligns with, and partially relies upon, this court's reasoning in Jimenez v. FCI Berlin, Warden, --- F. Supp. 3d ----, 2025 WL 2639390 (D.N.H. Sept. 8, 2025). A status conference (via video) shall be scheduled for 11 a.m. tomorrow to determine whether the government continues to adhere to its position in doc. no. 7. If the government submits a filing prior to the hearing confirming adherence to the position in doc. no. 7, the hearing will be cancelled. So Ordered by District Judge Landya B. McCafferty.(de)
