This is a text only entry; no document issued.ORDER SETTING HEARING: Earlier today (Sunday), Petitioner filed a habeas corpus petition along with an emergency motion for a temporary restraining order asking that Defendants be prevented from removing Petitioner from the District before his petition can be heard. Petitioner's counsel contends Petitioner's alleged unlawful deportation is imminent and it should be delayed until the Court can decide the merits of his petition. The Court finds that a hearing is necessary on the Petitioner's Emergency Motion for a Temporary Restraining Order. Accordingly, the Court will hear that motion tomorrow (Monday) at 2:00 P.M. Eastern Time. The hearing shall be conducted remotely. Instructions for connecting to the hearing will be forwarded tomorrow morning. In the meantime, Defendants shall not remove Petitioner from the Middle District of Georgia until further order of the Court. The Court will make a final decision on Petitioner's motion for temporary restraining order after the Monday hearing. The Court is not finding today that the elements for a TRO have been satisfied but is maintaining the status quo for this short period until the matter can be heard on Monday. Petitioner's counsel shall promptly forward this text order to Roger Grantham, Middle District Assistant U.S. Attorney, who shall inform the Defendants of this order. Ordered by US DISTRICT JUDGE CLAY D LAND on April 27, 2025. (CDL) (Entered: 04/27/2025)
