The Third Circuit has held that "a habeas court with jurisdiction does not lose it because a detainee has moved out of the district" Khalil v. President, United States, 165 F.4th 259 (2026) (referencing Ex parte Endo, 323 U.S. 283, 307 (1944)). The Supreme Court reaffirmed this principle in Rumsfeld v. Padilla, 542 U.S., 441 (2004), wherein the Court explained "[w]hen the government move a habeas petitioner after she properly files a petition naming her immediate custodian, the District Court retains jurisdiction." Accordingly, Petitioner is directed to show cause why the issues brought before this Court within his Petition for Writ of Habeas Corpus (ECF No. 1 ) should not be transferred to the Middle District of Georgia, which ordered the bond hearing that Petitioner currently challenges and had jurisdiction over Petitioner's original Petition for Writ of Habeas Corpus, for resolution. Petitioner has until May 5, 2026 to file a brief addressing this jurisdictional issue. Respondents have until May 12, 2026 to respond. The briefing schedule set out in the Case Management Order, at ECF No. 4, is deferred until this Court rules on this jurisdictional issue. Signed by Judge Marilyn J. Horan on 4/28/2026.
