TEXT ORDER: The Petitioner has filed a Petition for Writ of Habeas Corpus (ECF No. 1 ) arguing that his arrest and continued detention by immigration officials is unlawful, and seeking immediate release from detention and a bond hearing. After the Court received the Respondents response in opposition and Petitioner's reply thereto, the Court held a hearing and discussed the issues raised. The Court is in receipt of the supplemental briefing it requested from the Respondent. Based on the Respondent's modified position, the Court concludes that whether Petitioner is properly detained under 8 U.S.C. § 1226(c) must be decided by an Immigration Judge. Thus, the Court ORDERS the Respondents to schedule a hearing in Immigration Court for this issue to be squarely presented therein. Until such hearing, the Petitioner shall remain detained and the Petition for Writ of Habeas Corpus shall remain pending.
