MINUTE ORDER: The 3 Motion for Leave to Proceed in forma pauperis is DENIED WITHOUT PREJUDICE. The Court has discretion when determining whether to permit or deny an application to proceed IFP. 28 U.S.C. § 1915(a). To be entitled to that status, the movant must "submit[] an affidavit," id., demonstrating that because of poverty, the movant cannot "pay or give security for the costs... and still be able to provide [for] the necessities of life." McKelton v. Bruno, 428 F.2d 718, 71920 (D.C. Cir. 1970). The document submitted by Plaintiff's counsel does not satisfy these requirements. While the Court recognizes that counsel may be unable to contact Plaintiff, it is unclear from the materials presented whether counsel has made any effort to obtain information about Plaintiff's financial situation. Without information about Plaintiff's financial situation, the Court cannot evaluate Plaintiffs ability to pay the filing fee. See, e.g., Masek v. United States, No. CV 22-03574 (RC), 2024 WL 1240093, at *6 (D.D.C. Mar. 22, 2024) ("Because of the absence of any financial information, the Court denies [plaintiff's] motion to proceed in forma pauperis."); Chavira v. DHS., No. MC 25-0047 (UNA), 2025 WL 1567836 (D.D.C. May 7, 2025) (same). Plaintiff must pay the filing fee or submit a sufficient affidavit detailing Plaintiff's inability to pay the fee. SO ORDERED.
