MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 4/27/2026: The court has reviewed Petitioner's 1 Petition for Writ of Habeas Corpus and 2 Motion for Temporary Restraining Order. The court has previously addressed the legal issues raised by Count Two of the Petition. See, e.g., Hoac v. Becerra, No. 2:25-cv-01740-DC-JDP, 2025 WL 1993771 (E.D. Cal. July 16, 2025), Vuong v. Becerra, 1:25-cv-01847-DC-CSK, 2025 WL 3707172 (E.D. Cal. Dec. 22, 2025), and El-Ghazaly v. Chestnut, 1:25-cv-01621-DC-CKD, 2025 WL 3485030 (E.D. Cal. Dec. 4, 2025). The court is contemplating ruling directly on the 1 Petition, with the understanding that the court will also consider any arguments made and exhibits submitted in support of the Motion for Temporary Restraining Order. See Fed. R. Civ. P. 65(a)(2) ("Before or after beginning the hearing on a motion for a preliminary injunction, the court may advance the trial on the merits and consolidate it with the hearing."); see also 28 U.S.C. § 2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require."); A.R. v. Chestnut, No. 1:26-cv-00551-KES-SAB, 2026 WL 227112, at *1 (E.D. Cal. Jan. 28, 2026) (considering preliminary injunction and merits of habeas petition simultaneously). Respondents shall file an Opposition or Statement of Non-Opposition to the 2 Motion for Temporary Restraining Order by 12:00 PM on 4/29/2026. In their response, Respondents shall substantively address whether there are any factual or legal issues in this case that materially distinguish it from the court's prior orders listed above. Petitioner may file a Reply by 5/13/2026. Both parties should address whether they oppose the court ruling directly on the Petition, albeit as to Count Two only, to the extent a ruling on that Count entitles Petitioner to the relief sought in the Petition. MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 5/15/2026: In Respondents' 7 Opposition to Petitioner's 2 Motion for a Temporary Restraining Order, Respondents distinguish Petitioner's claim from those cited in the court's 5 Order by emphasizing that the petitioners in those cases were subject to a final order of removal when they were released into the United States, whereas here, Petitioner reentered the United States following his previous removal, and his previous order of removal was then reinstated pursuant to 8 U.S.C. § 1231(a)(5). Respondents attach Petitioner's [7-1] order of reinstatement showing that his order was reinstated on 4/22/2026. Petitioner did not file a Reply rebutting Respondents' allegations and his time to do so has expired. Thus, Petitioner is subject to mandatory detention during the 90-day "removal period" following reinstatement of his order of removal pursuant to 8 U.S.C. § 1231(a)(2), and he is therefore unlikely to succeed on the merits of his claim that he is presently unlawfully detained under 8 U.S.C. § 1226(a) or that his present two-month detention violates his constitutional right to due process. Accordingly, Petitioner's 2 Motion for a Temporary Restraining Order is DENIED. This case is REFERRED to the assigned Magistrate Judge for further proceedings. MINUTE ORDER issued by Relief Courtroom Deputy for District Judge Dena M. Coggins on 5/27/2026: The court has reviewed Petitioner's 10 Motion for Reconsideration and Respondent's 11 Supplemental Response to Petitioner's Petition for Writ of Habeas Corpus. In Respondent's 11 Supplemental Response, Respondent states that Petitioner was removed to Honduras on 5/22/2026 and therefore requests that the court deny Petitioner's 1 Habeas Petition as moot. Respondent does not address Petitioner's 10 Motion for Reconsideration, in which Petitioner states that on 5/14/2026 an immigration judge denied Petitioner's request for withholding of removal to Honduras, and that on 5/16/2026, Petitioner timely filed a Notice of Appeal to the Board of Immigration Appeals challenging the immigration judge's decision. Petitioner attaches to his 10 Motion for Reconsideration a payment receipt from the Board of Immigration Appeals showing that his appeal was processed on 5/15/2026. Under 8 C.F.R. § 1003.6(a) the decision of an immigration judge "from which an appeal to the Board may be taken shall not be executed during the time allowed for the filing of an appeal unless a waiver of the right to appeal is filed, nor shall such decision be executed while an appeal is pending...." Here, Petitioner was removed before his 30-day appeal period following the immigration judge's 5/14/2026 decision expired, and while his appeal to the Board of Immigration Appeals was pending. Accordingly, Respondent is DIRECTED to file a Response to Petitioner's 10 Motion for Reconsideration on or before 12:00 PM on 6/1/2026. In that Response, Respondent shall address: (1) whether Respondent contends that the automatic stay provided for under 8 C.F.R. § 1003.6(a) does not apply to Petitioner's pending appeal; (2) whether Petitioner's removal was contrary to that regulation; and (3) if so, why Petitioner was removed in violation of that regulation.
