ORDER by Judge Derrick K. Watson, On April 24, 2026, Petitioner Armen Martirosyan, proceeding with counsel, filed a combined petition for writ of habeas corpus and emergency motion for temporary restraining order. Dkt. No. 1. The same day, pursuant to General Order 26-05, the Court set a briefing schedule on the petition for writ of habeas corpus, requiring an answer by May 1, 2026, and a reply within three days thereafter. Dkt. No. 4. On May 1, 2026, i.e., today, the government filed an answer to the habeas corpus petition. Dkt. No. 9. In light of this expedited briefing schedule on the underlying petition, and after review of the combined petition and motion for temporary restraining order, the Court is unconvinced that emergency relief is necessary in this case. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (explaining that a petitioner must establish he is likely to suffer irreparable harm in the absence of preliminary relief.). Accordingly, to the extent Petitioner seeks emergency injunctive relief in this case, such relief is DENIED WITHOUT PREJUDICE. Proceedings on the merits of the underlying habeas petition shall continue before the Magistrate Judge.
